Terms of Service

Welcome to MAO Workforce. These Terms of Service ("Terms") govern your access to and use of the MAO Workforce platform, including maoworkforce.com and portal.maoworkforce.com (collectively, the "Platform"), operated by MAO Workforce ("we," "our," or "us").

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• Be authorized to represent and bind your business entity
• Have a valid business operating in the Philippines
• Provide accurate, complete, and current registration information

2. Account Registration

You must create an account to access the Platform. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use at hello@maoworkforce.com

3. Subscription Plans and Billing

3.1 Plans

• Free — ₱0 forever, up to 10 employees, attendance and kiosk only
• Starter — ₱399/month (or ₱319/month billed annually), up to 25 employees
• Growth — ₱899/month (or ₱719/month billed annually), up to 50 employees
• Pro — ₱1,899/month (or ₱1,519/month billed annually), up to 100 employees
• Enterprise — Custom pricing; contact hello@maoworkforce.com

3.2 Free Trial

All paid plans include a 30-day free trial. No credit card is required to start. At the end of the trial, you may subscribe or downgrade to the free plan. Your data will not be deleted if you downgrade.

3.3 Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are in Philippine Pesos (PHP) and are non-refundable unless required by applicable law. We reserve the right to change pricing with 30 days advance notice.

3.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.

4. Acceptable Use

You agree to use the Platform only for lawful purposes. You must not:

• Use the Platform for any illegal activity or to violate applicable Philippine laws
• Input false, misleading, or fraudulent employee or payroll data
• Attempt to gain unauthorized access to other accounts or our systems
• Reverse engineer, decompile, or disassemble any part of the Platform
• Use the Platform to distribute malware, spam, or harmful content
• Resell or sublicense access to the Platform without our written consent
• Use automated tools to scrape or extract data from the Platform

5. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, incorporated into these Terms by reference. You retain ownership of all data you input. You grant us a limited license to process this data solely to provide the services.

6. Compliance with Philippine Laws

MAO Workforce computes statutory contributions based on official government rates. However:

• We are not a licensed accounting firm, law firm, or BIR accredited agent
• You remain solely responsible for the accuracy of payroll data you input
• You are responsible for filing required government remittances (SSS, PhilHealth, Pag-IBIG, BIR)
• We are not liable for penalties arising from incorrect data entry or late remittances

7. Intellectual Property

The Platform and all its content are owned by MAO Workforce and protected by applicable intellectual property laws. The MAO Workforce name, logo, and mascot (Maomao) are trademarks of MAO Workforce. Unauthorized use is prohibited.

8. Third-Party Services

The Platform integrates with third-party services including Supabase, Vercel, Resend, and Anthropic. Your use of these services is subject to their respective terms. We are not responsible for the availability or conduct of third-party services.

9. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, MAO Workforce shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption.

Our total liability for any claim shall not exceed the total fees paid by you in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless MAO Workforce from any claims, damages, and expenses arising from your violation of these Terms, applicable law, or any third-party rights.

12. Termination

We may suspend or terminate your access at any time if you violate these Terms. Upon termination, you may request a data export within 30 days. After 30 days, your data may be deleted.

13. Modifications to Terms

We may update these Terms at any time. We will notify you of material changes by email or by posting a notice on the Platform. Continued use after the effective date constitutes acceptance.

14. Governing Law

These Terms shall be governed by the laws of the Republic of the Philippines. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Philippines.
